Mrs Gibbons Flowers responsibilities – It is the responsibility of Mrs Gibbons Flowers to complete the following duties:
• Assistance with colour schemes and flower choices, as well as arrangement, construction, style, structure, and theme ideas if required. • Make ourselves available and reply responsively to all communication and questions from our clients at no additional cost. • Site visits if required (travel fees may apply). • Construction of flower arrangements as per final quote. • On day delivery, set up and dismantle if required – please note charges will apply. • Treating your event with the utmost priority and respect. • Supplying you with original, unique and swoon worthy flowers! •.
Client responsibilities – It is the responsibility of the Client to complete the following duties:
• The client/clients agrees to make payments on time as per their agreed quotation. • The client/clients agrees to submit all changes that affect the duties of the florist, in writing to Mrs Gibbons Flowers, on or before 6 weeks prior to their event date. • The client/clients assumes all responsibility for the condition of the order and other goods after delivery or pickup. • The client/clients acknowledges that, unless they have selected a pack-down service, they are responsible for the clean and prompt return of all hired items to Mrs Gibbons Flowers within three (3) days of their event. If hire items are not returned within 3 days, full retail cost will be charged to your credit card. • The client/clients agrees to abide by terms, conditions and policies as outlined below. • The client/clients acknowledges that flowers depend on many environmental factors and are subject to seasonal/natural variances and as such; put their trust in Mrs Gibbons Flowers to select beautiful flowers on their behalf that best suit the brief and that are fit for purpose. • The client agrees that should you wish to cancel or move your wedding to another date once all flowers and product have been ordered you will need to cover the wholesale cost of goods on the new date.
Acceptance of Terms and Conditions:
The quote validity is 7 days. We require a 30% non-refundable booking confirmation payment upon booking which is deducted from your total quote (Please note your date will not be secured until we receive the 30% booking confirmation payment) Or if your event is a short lead time, FULL PAYMENT will be required which is non-refundable should this fall within 6 weeks of your event date. By making this payment you are acknowledging the terms and conditions of this quote). By paying the 30% non-refundable booking confirmation payment or FULL payment you are ACKNOWLEDGING YOU HAVE READ AND UNDERSTAND THIS AGREEMENT, AND YOU ACCEPT AND AGREE TO ALL ITS TERMS AND CONDITIONS.
By booking with Mrs Gibbons Flowers and paying the non-refundable booking confirmation required, the client hereby unconditionally accepts the terms and conditions listed. Mrs Gibbons Flowers Terms and Conditions may be changed without notice. Any additions to this quote/invoice can be added up until 6 weeks before the event, however you cannot subtract from the agreed total of goods/items agreed on this quote.
Non-refundable booking confirmation payment paid upon booking remains ours in an event of cancellation or change of mind or pandemic. Cancellation within 6 weeks of your event date remain payable in full. Bookings can be postponed to a later date, subject to our availability, a minimum of 6 weeks’ notice is required. Any orders postponed must fall within 12 months of original wedding date booked, after 6 months’ prices will be subject to change. Mrs Gibbons Flowers reserves the right not to provide services or products or to cancel orders at our sole discretion at any time without limiting the operation of the terms and conditions. Mrs Gibbons Flowers will not be held liable for loss or damage arising from the exercising of these rights.
Exclusivity Policy
• Mrs Gibbons Flowers shall be the exclusive florist retained by the client/clients for providing floral design and flowers for their event. • Mrs Gibbons Flowers retain the right to cancel a booking should this clause not be adhered to • Mrs Gibbons Flowers are a full-service florist and will not provide fresh or sundry goods, impart knowledge, or share information for the purposes of a client seeking to ‘DIY’ floral products.
2. Payment information
• The preferred method of payment to Mrs Gibbons Flowers is via direct debit or credit card. Mrs Gibbons Flowers can be found at the bottom of each invoice. • Mrs Gibbons Flowers require an upfront 30% non-refundable booking confirmation payment before securing your event. This booking confirmation payment/design fee/retainer is non-refundable under any circumstance. Regrettably, we cannot hold your date without a booking confirmation payment the amount of which will be clearly outlined within your quote and is amended in accordance with the scale of works proposed. Once paid, this agreed booking confirmation payment amount will be deducted from the balance owing of your order. • Final payment of the balance of your invoice is to be received 6 weeks prior to your wedding date. This due date will be clearly outlined on your invoice. Mrs Gibbons Flowers are not responsible for contacting you or reminding you of the final payment cut-off date. • Mrs Gibbons Flowers will not order your wedding flowers or complete your arrangements without final payment. Delayed final payment, resulting in a late order, may result in missing your desired flower varieties. Mrs Gibbons Flowers will not be held accountable for disappointment or dissatisfaction due to substitution caused by late payment. Fees may incur for late payments made to Mrs Gibbons Flowers. • Event flowers will not be delivered unless final payment is made. Failure by the client/clients to make the final due payment as per invoice due date is sufficient cause for Mrs Gibbons Flowers to cancel the event, no refunds will be issued. • No changes or cancellations to the proposal and/or invoice can be made within 6 weeks of the event date. Any additions to this quote/invoice can be added up until 6 weeks before the event, however you cannot subtract from the agreed total of goods/items agreed on this quote. Partial refunds on moneys already paid to date will not be given should you change your mind after a proposal has been accepted. This may result in additional stems being included within a design than were initially quoted or an increase in the overall size of an item, however a refund will not be given on the difference in requested order value.
3. Availability, Variations and Weather
• When working with nature, there are no guarantees. We will deliver your flowers to our impeccable standards; however we cannot be held liable for extreme heat, wind and excessive rain. We will do our absolute best to supply everything you wished for in your floral details, however due to variances in the weather & seasonal availability of some flowers, we cannot guarantee availability, exact colours or shades. Should we need to substitute any flowers for you, we will select what we feel is the next best option at an equal colour, form and value of bloom. • Please remember…. we are not nature; we simply work with it and with nature there are no guarantees. As such we will not be held liable for perishable goods unavailable to us at the time of your event and you accept that as a creative process, Mrs Gibbons Flowers will make choices based on value, suitability for purpose and availability on your behalf without your consultation. • No refunds, partial or full, will be issued based on Mrs Gibbons Flowers decision to substitute fresh floral items. • Should the overall value of your order substantially alter due to a required substitution of flower content, Mrs Gibbons Flowers will allocate this value to another portion of the order. This may result in additional stems being included within a design than were initially quoted or an increase in the overall size of an item Products sold by Mrs Gibbons Flowers are a perishable, natural item and flowers life span is dependent on species, resulting in some flower varieties living longer than others. Flowers are product of nature; availability is dependent on season and markets. As a result, not all goods produced are as pictured, by accepting these terms and conditions you are acknowledging there may be discrepancies between images and produced goods.
4. Hired Items
• The client/clients are responsible for any items hired from Mrs Gibbons Flowers. This may include but is not limited to, vases, candle holders, glassware, and framework for floral installations. • A bond of up to $500 is required for any non-perishable items hired from Mrs Gibbons Flowers. This bond is to be paid within 4 weeks of your wedding to Mrs Gibbons Flowers. If providing a cash bond, this should be arranged to be paid in person at a time mutually convenient to both the client and Mrs Gibbons Flowers. Alternatively, a credit card number is kept on file. The credit card will not be charge unless the items are retuned damaged, dirty, or broken. Cash bonds will be refunded on the safe and clean return of the items to Mrs Gibbons Flowers within three (3) days of your event. • It is the responsibility of the client/clients to ensure the safe return of all hired items to Mrs Gibbons Flowers. Failure to return items within three (3) days of your event will result in a loss of your bond and incur a fee of $150 per day until the items are returned. • In the event that Mrs Gibbons Flowers hired items have been abandoned at the venue and collection by Mrs Gibbons flowers is required, additional collection fees apply. • All hired items must be returned to Mrs Gibbons Flowers washed and clean of candle wax, flower matter and water. Failure to return items cleaned and dry will incur a cleaning fee of $50 per hour.
5. Floral Installations and Permissions
• It is the responsibility of the client/clients to liaise with both ceremony and reception venues regarding the construction of floral installations and hired items that may cause damage. This includes but is not limited to items such as open flame candles, stakes into the ground (particularly grass) and hanging instalments on existing beams and structures. • The responsibility remains with the client/clients to seek permission on behalf of Mrs Gibbons Flowers to complete any hanging, suspended or other uncommon floral installations at any venue. Mrs Gibbons Flowers will not be held responsible or liable for any instances where work cannot be completed due to a lack of permission or lack of safety at the venue.
6. Photography
• Mrs Gibbons Flowers retain the right to photograph finished work which may be used in self-promotion and advertising. • Mrs Gibbons Flowers agree to hold off from posting any images to social media until after the wedding ceremony has begun. • Photos taken by us of your arrangements remain our property. Our photos are not to be reproduced, copied, or edited in any way by you or any third party without our prior permission to in writing to do so
7. Mock-ups
• Clients spending more than $7,500 on an event with Mrs gibbons Flowers can request to see a mock-up of a table arrangement or bouquet charged at 50% of the quoted price. • This arrangement is not for the client/clients to keep and remains the property of Mrs Gibbons Flowers. However, the mock-up arrangement can be purchased to keep for the full quoted price. • client/clients understands that a mock-up is a rough guide only for the purposes of illustration as not all desired flower varieties will be in season at the time of your preview appointment.

8. Setup and Delivery
• Setup (bump in) and delivery times for all personal flowers, ceremony sites and reception sites are given as approximates. • While we endeavour to arrive within the 30-minute window specified; for reasons out of our control these are not always achievable on the day. Please note that this 30-minute time slot is an approximate arrival time only and does not include time to setup the event. • Mrs Gibbons Flowers endeavour to keep day-of contacts updated on delivery times if they are to change on the day of your event or wedding • Mrs Gibbons Flowers is not liable for delivery times that change due to unforeseen circumstances wherein the delivery and setup of all items are completed before start times. For example: a 1pm ceremony start time with a completed bump in time of 12.50pm is more than acceptable. • In the event that Mrs Gibbons Flowers do not fulfil a bump in before the allocated event start time, a full refund of any missing items will be paid via direct debit within 7 days of receiving the client’s bank account information. • Customer pickups are not permitted. Deliveries are scheduled from 7am onwards. We will confirm your delivery time for you in the week before your event or wedding date. We will do our absolute best to deliver when you request us to. • The goods shall be deemed to have been delivered when they are delivered to the address given to Mrs Gibbons Flowers by the Customer or consignee for that purpose. • Flowers and foliage are not for human or animal consumption. You must advise us when placing the order for flowers if the Recipient has any allergies to particular types of flowers. If you do not do so then we will not be able to take any allergies into account when supplying the products and cannot be held liable for injury or losses associated with allergy or illness as a result.
9. In the Event of an Emergency (Force Majeure)
• In the event that Mrs Gibbons Flowers is unable to perform any of its obligations whether wholly or partly by reason of any cause beyond its control (including without limitation acts of God, inclement weather, site access failure, time access inaccuracies, civil commotion, unrest or riots, civil or military interference including acts of war or terror, pandemic), Mrs Gibbons Flowers will provide a written statement to the client/clients outlining full particulars of such force majeure in which case the obligation of the owner under these terms shall, to the extent that they are affected by the force majeure, be suspended during the term of the force majeure. Mrs Gibbons Flowers shall not be liable for any loss or damage suffered by the client/clients as a result of any delays caused by such force majeure events. • Mrs Gibbons Flowers reserves the right to cancel any event if at any time they feel that the obligations cannot be met and all suitable alternatives have been exhausted. • In the event that Mrs Gibbons Flowers are unable to complete their responsibilities or in the event of isolated disasters such as damage to the Mrs Gibbons Flowers design studio, vehicle, or staff; liability is limited to a full refund of all monies paid to Mrs Gibbons Flowers only, no additional claims of compensation will be entered. • If Mrs Gibbons Flowers are unable to complete their responsibilities for the event, every effort will be made for Mrs Gibbons Flowers to source and introduce a replacement florist with a similar style and skill level to Mrs Gibbons flowers. The client/clients are under no obligation to move forward with a florist suggested by Mrs Gibbons Flowers.
10. Cancellation, Postponement and Refund Policy
• Mrs Gibbons Flowers puts its utmost 100% attention to each client/clients on the day of their event. • In the unfortunate event that your event or wedding is cancelled, Mrs Gibbons flowers requires a minimum of 6 weeks’ notice from the client/clients. All cancellations are to be made in writing from the client/clients to Mrs Gibbons Flowers. • Mrs Gibbons Flowers have a cancelation fee of $500. • On cancellation of your event; the couple will receive a refund of the balance of monies paid, less the non-refundable booking confirmation amount, less the cancelation fee of $500 if applicable, less any non-perishable items purchased on behalf of the client/clients for their event (such as vases, ribbons, floral foam, sub-contracted hire items and other non-perishable construction materials), and less a fee of $70 per hour for time incurred in meetings, mock-ups, emails, planning and sourcing made by Mrs Gibbons Flowers for the event. These additional costs are considered liquidated damages to Mrs Gibbons Flowers in the event of a terminated event or wedding by the client/clients within 6 weeks of their event. • Strictly no refunds are extended to the client/clients on orders cancelled within 6 weeks of their event. • There are no refunds given for cancellations of individual items or requested deduction to the size or quantity of items as per the agreed quote within 6 weeks days of the couple’s event. Value for requested items to be removed, cancelled, or reduced will be utilised to upgrade the arrangements and items purchased by overall size or floral content (i.e. By additional stems or premium flower choices).
• Bookings can be postponed to a later date, subject to our availability, a minimum of 6 weeks’ notice is required. Any orders postponed must fall within 12 months of original wedding date booked, after 6 months’ prices will be subject to change. If you decide to postpone your wedding date and decide to have a small elopement or civil ceremony on your original date and wish to use the booking confirmation payment towards your civil ceremony we will require a $250.00 plus GST payment to secure your new postponement date as we will be holding two dates for your event. Alternatively we will roll your non-refundable booking confirmation payment over to your postponement date and quote separately for your ceremony.
11. Privacy
• Your order, event date, contact details (address, phone, email), & credit card details will be treated with complete privacy. We will not speak with any media representative or release any information unless you give us consent to do so.
